Terms & Conditions
These Terms & Conditions govern your use of the Lighthouse Construction Management website and services. By accessing or using our site, you agree to these terms.
1. Acceptance of Terms ️
By using lighthousecmco.com (the “Site”) or engaging Lighthouse Construction Management (“Lighthouse,” “we,” “us,” or “our”) for services, you accept and agree to these Terms & Conditions, our Privacy Policy, and any additional terms posted on the Site.
2. Services & Engagement
Descriptions of our services, including owner’s representation, project recovery, preconstruction advisory, and cost & schedule control, are provided for informational purposes. Any engagement for professional services is subject to a separate written agreement that defines scope, fees, deliverables, schedules, and responsibilities. Nothing on the Site constitutes a binding offer to perform services without a signed agreement.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to: (a) use the Site for unlawful or fraudulent activities; (b) attempt to gain unauthorized access to our systems; (c) interfere with or disrupt the Site or servers; or (d) copy, reproduce, or republish content from the Site except as expressly permitted by these Terms or by us in writing.
4. Intellectual Property
All content on the Site — including text, images, logos, designs, and code — is owned or licensed by Lighthouse and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written permission. Limited use for personal, non-commercial review is permitted provided you keep all copyright and proprietary notices intact.
5. External Links
The Site may contain links to third-party websites for convenience and reference. These links do not imply endorsement. We are not responsible for third-party content, practices, or privacy policies.
6. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WHILE WE STRIVE FOR ACCURACY, WE DO NOT GUARANTEE THAT INFORMATION ON THE SITE IS COMPLETE, CURRENT, OR ERROR-FREE. NOTHING ON THE SITE CONSTITUTES PROFESSIONAL ADVICE OR A SUBSTITUTE FOR A WRITTEN CONSULTING AGREEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIGHTHOUSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.
8. Third-Party Providers
We may use third-party service providers for hosting, payment processing, analytics, email delivery, and other functions. Those providers may have their own terms and privacy policies; by using our Site you also agree to abide by such provider terms where applicable.
9. Payment & Refunds
Fees for services are set forth in separate engagement agreements. Where applicable, payments may be required in advance, and additional costs (e.g., permits, consultants, long-lead items) may be billed to you. Refund policies will be specified in the engagement agreement.
10. Cancellation & Termination
Either party may terminate a services agreement as provided in the engagement contract. Termination does not relieve either party of obligations incurred prior to termination, including payment for services performed and reimbursable expenses.
11. Indemnification
You agree to indemnify and hold harmless Lighthouse, its affiliates, officers, and employees from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Site or services.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of California without regard to conflict of law provisions. Any dispute arising under or related to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Monterey County, California.
13. Changes to Terms
We may update these Terms from time to time. The revised version will be effective when posted on the Site with an updated “Last Updated” date. Continued use of the Site after changes indicates your acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
